      <title>Medical Couple May Have Contributed to 56 Overdose Deaths</title>
      <description>&lt;p&gt;A doctor and his wife are thought to have caused the &lt;a href="http://www.foxnews.com/story/0,2933,317969,00.html"&gt;overdose deaths&lt;/a&gt; of at least four patients by prosecutors.  The couple will remain in jail because they are a flight risk, a federal magistrate ruled Friday.&lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;Dr. Stephen J. Schneider and his wife, nurse Linda K. Schneider, pleaded not guilty in U.S. District Court to counts including conspiracy, unlawful distribution of a controlled substance, health care fraud, illegal monetary transactions and money laundering.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;&lt;br /&gt;The couple has not been charged with killing any of their patients but they are still being held in prison because they pose a danger to the community.   U.S. Magistrate Judge Donald Bostwick stated that even if Schneider was ordered to not practice medicine there was no way the court could police that stipulation.&lt;/p&gt;&lt;p&gt;The clinic that the Schneider's work in has been under investigation for a few years by the feds and in September was raided.  Prosecutors claim that the couple continued to commit fraud while they knew their clinic was being investigated.&lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;According to the indictment, 56 of the doctor's patients have died from accidental prescription drug overdoses in the past five years.       <title>Deadlocked Jury in Olesky Malpractice Case</title>
      <description>&lt;p&gt;A Collier County jury was deadlocked today after 2.5  days of deliberation in a &lt;a href="http://www.naplesnews.com/news/2006/dec/12/jury_deadlocked_malpractice_case/?latest"&gt;medical malpractice and wrongful death lawsuit&lt;/a&gt;. The lawsuit involves two local physicians and a physician assistant in the death of Ann Olesky, before her death in 2004.&lt;/p&gt;&lt;p&gt;The jury of four women and two men were sent back into deliberations by the Judge. &lt;/p&gt;&lt;p&gt;&lt;br /&gt;&lt;blockquote&gt;The defendants are Dr. Dennis Stapleton, a cardiothoracic surgeon who performed mitral and aortic valve replacement surgery on Olesky, and Dr. Jane Silverstein, a cardiologist who was filling in for Olesky's regular physician at Naples Community Hospital. The hospital was not named in the lawsuit. A third defendant is Joseph Deily, a physician's assistant to Stapleton.&lt;/p&gt;&lt;p&gt;The plaintiff's attorney argued during a two-month trial that the defendants failed to detect Olesky took a turn for the worse and failed to order tests that could have detected bleeding in her heart, which led to it being squeezed.&lt;br /&gt;The defense argued she could not have been detected or treated.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;Prior to the judge sending the jury back to reconsider the deadlock, the forewoman told the judge that they had deadlocked on Monday and agreed to sleep on it and start again today.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;&lt;/p&gt;&lt;a href="http://wichita.injuryboard.com/medical-malpractice/deadlocked-jury-in-olesky-malpractice-case.aspx?googleid=209122"&gt;Originally posted&lt;/a&gt; at &lt;a href="http://www.InjuryBoard.com"&gt;InjuryBoard&lt;/a&gt; by &lt;a href="http://www.injuryboard.com/Christina-Cole/"&gt;Christina Cole&lt;/a&gt;</description>
